1. Service Description
Persai.ai (“Persai”, “we”, “our”, or “us”), operated by MagicStone LLC, provides an AI-powered social media management platform for Threads and Instagram by Meta, TikTok, and LinkedIn (collectively, the “Supported Platforms”). Our service includes:
- AI content generation: Creating original posts for the Supported Platforms based on your configured persona (tone, topics, writing style, language)
- Content scheduling and publishing: Scheduling posts for future publication and publishing them to your connected Threads, Instagram, TikTok, and/or LinkedIn accounts at the designated time
- AI replies (Threads and Instagram only): Automatically generating and publishing replies to comments on your posts and mentions of your account, based on your persona configuration and approval settings. AI replies are not currently available for TikTok or LinkedIn
- Content remixing: Generating posts from source materials (URLs, text snippets) using customizable prompt templates
- Persona management: Configuring and managing AI influencer personas that define the voice and style of generated content
- Account sync: Importing existing posts (and, where the platform API supports it, replies) from your connected Threads, Instagram, TikTok, and/or LinkedIn accounts to analyze your writing style
By accessing or using Persai, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service.
2. Account Authorization and Eligibility
To use Persai, you must:
- Be at least 18 years of age
- Have a valid account on at least one Supported Platform (Threads, Instagram, TikTok, or LinkedIn). For Instagram, a Facebook account linked to your Instagram Business or Creator profile may also be required, per Meta’s requirements. For TikTok, your account must meet TikTok’s eligibility criteria for the Content Posting API (including, where applicable, region and account-type requirements)
- Provide accurate and complete information during registration and keep it up to date
- Have the authority to authorize Persai to access and publish content on each Supported Platform account you connect
When you connect an account, you authorize Persai to access your account data, create and publish content, and — where applicable — manage replies on your behalf through the relevant platform API: Meta’s Threads API and Instagram Graph API, the TikTok for Developers API (including the Content Posting and Display APIs), and the LinkedIn Marketing Developer Platform / Posts API. This authorization is granted via each platform’s OAuth flow, where you explicitly approve the requested permissions on a per-platform basis. Connecting one platform does not grant Persai access to any other platform.
You are responsible for maintaining the security of your Persai account credentials. You are liable for all activity that occurs under your account.
3. Content Processing and Standards
All content generated through Persai — including posts, replies, and remixed content — is created using AI (OpenAI and/or Anthropic) based on your persona configuration and input materials.
You agree that:
- You are solely responsible for all content published through your connected Supported Platform accounts, whether AI-generated or manually created
- All content must comply with the applicable platform rules and policies, including the Threads Community Guidelines, the Instagram Community Guidelines, the TikTok Community Guidelines, the LinkedIn Professional Community Policies, and applicable laws
- You will not use Persai to generate spam, harassment, hate speech, misinformation, or any content that violates the policies of Meta, TikTok, or LinkedIn
- You will configure your AI persona responsibly, including using the blacklist feature to prevent generation of inappropriate content
- You understand that AI-generated content may occasionally produce unexpected or inaccurate results, and you are responsible for reviewing content before or after publication
Persai provides approval modes (automatic and manual) that allow you to review AI-generated content before it is published. We strongly recommend using manual approval mode, especially when first configuring your persona.
4. User Support and Reporting
If you encounter issues with the service, have concerns about AI-generated content, or need to report a problem, you can contact our support team at support@persai.ai.
We respond to support inquiries within 1 business day. For urgent issues — such as unwanted content being published or security concerns — please include “URGENT” in your email subject line.
You can immediately stop all AI activity on your account by using the “Pause” feature on any brand, which halts all content generation and publishing until you resume it.
5. Service Limitations
You acknowledge and agree that:
- Persai depends on third-party platform APIs — the Threads API and Instagram Graph API (Meta), the TikTok for Developers API (TikTok), and the LinkedIn Marketing Developer Platform / Posts API (LinkedIn). Changes to these APIs, policies, or rate limits may affect service functionality
- AI-generated content quality depends on your persona configuration and the underlying AI models, which may change over time
- Scheduled posts may be delayed due to API rate limits, service outages, or other technical factors
- We do not guarantee specific engagement metrics, follower growth, or content performance on any Supported Platform
- Token refresh cycles depend on each platform’s token expiration policies; we automatically refresh tokens where the platform supports it (e.g., Meta long-lived tokens, TikTok refresh tokens, LinkedIn refresh tokens), but cannot guarantee uninterrupted access if the platform revokes authorization or if a refresh token expires and re-authorization is required
- Each Supported Platform has its own publishing constraints (e.g., supported media types, caption/post length, carousel and video limits, scheduling windows, member-context vs. organization-context posting, draft vs. direct-publish modes). Persai will surface relevant errors when a draft cannot be published to a given platform
- Content extraction from URLs depends on the source website’s structure and accessibility
6. Platform Compliance
Persai operates in compliance with each platform’s developer policies:
- Meta: Meta Developer Policies, Meta Platform Terms, Threads Terms of Use, Threads API Terms, Instagram Terms of Use, and the Instagram Platform Policy
- TikTok: the TikTok for Developers Terms of Service and the Content Posting API guidelines (including any required disclosure of branded or commercial content)
- LinkedIn: the LinkedIn API Terms of Use and the LinkedIn API Platform Guidelines
We commit to:
- Using each platform’s API only for purposes authorized by that platform and consented to by users
- Respecting API rate limits and content policies established by Meta, TikTok, and LinkedIn
- Processing webhook data (replies, mentions, comments) only for accounts that have authorized our service
- Storing and encrypting OAuth tokens in accordance with each platform’s security requirements
- Promptly deleting user data when access is revoked or an account is disconnected
- Maintaining transparency about our use of AI in content generation
If Meta, TikTok, or LinkedIn revokes or restricts our API access for any Supported Platform, we will notify affected users and work to restore service as quickly as possible.
7. Service Availability and Termination
We strive to maintain high availability of Persai but do not guarantee uninterrupted service. Planned maintenance, infrastructure updates, and third-party dependencies may cause temporary disruptions.
Termination by you: You may stop using Persai at any time by disconnecting your Threads, Instagram, TikTok, and LinkedIn accounts and deleting your Persai account. Upon account deletion, all your data will be permanently removed in accordance with our Data Deletion Instructions.
Termination by us: We may suspend or terminate your access to Persai at any time, with or without notice, if:
- You violate these Terms of Service
- Your use of the service violates the community guidelines, terms of use, or developer policies of any Supported Platform (Threads, Instagram, TikTok, or LinkedIn)
- Your account is involved in fraudulent or abusive activity
- Required by law or a valid legal process
Upon termination, your right to use Persai ceases immediately. We will delete your data in accordance with our data retention policy.
8. Liability and Disclaimers
Persai is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, MagicStone LLC shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the service
- Content published to any Supported Platform account through Persai, including AI-generated content
- Any action taken by Meta, TikTok, or LinkedIn — including account suspension, content removal, or API access revocation — related to content published through Persai
- Loss of data, revenue, or business opportunities resulting from service interruptions
- Actions of third-party services (Meta, TikTok, LinkedIn, OpenAI, Anthropic, Cloudflare) that affect service functionality
Our total liability for any claims arising from or related to the service shall not exceed the amount you paid to us in the 12 months preceding the claim.
9. Data Protection and Privacy
Your use of Persai is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data. By using Persai, you consent to the data practices described in our Privacy Policy.
Key data protection measures include:
- AES-256-GCM encryption for all stored OAuth tokens
- HMAC-SHA256 verification for all incoming webhooks
- HTTPS encryption for all data in transit
- Role-based access control within organizations
- Right to request data deletion at any time (see Data Deletion Instructions)
10. Legal Compliance
These Terms of Service are governed by and construed in accordance with the laws of the United States. Any disputes arising from or relating to these terms or your use of Persai shall be resolved in the courts of competent jurisdiction.
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
11. Updates and Changes
We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by updating the “Last updated” date on this page and, for significant changes, by sending a notification via email or the Persai dashboard.
Your continued use of Persai after any changes to these terms constitutes your acceptance of the updated terms. If you do not agree with the updated terms, you must stop using the service and delete your account.
